Other factors that can classify the crime as a Class 2 felony include if the alleged victim is 60 years old or older, if the criminal sexual misconduct happens while another felony crime is conducted, or if the alleged victim is younger than 13 years old.

Sexual abuse for a first time offense is normally charged as a Class 4 felony. The punishment for this usually comes with one to three years in in prison as well as fines up to $25,000. Penalties become more severe with each subsequent offense.
